Debt-acknowledgment appeal ends at the permission stage
Al Rajhi’s application concerned whether an email could restart limitation when its writers misunderstood the underlying transaction.
The UK Supreme Court refused permission on 2 November in Al Othman’s dispute with Al Rajhi over an unadvanced loan. The application raised acknowledgment of debt under section 29(5) of the UK Limitation Act 1980.
The official summary says Al Othman relied on a 2018 email in proceedings issued in 2023. The High Court rejected the acknowledgment argument because the exchange referred to a share sale; the Court of Appeal concluded that it referred to the loan transaction.
The Supreme Court declined permission because the application presented neither an arguable legal point nor one of general public importance. That refusal supplies no reasoned Supreme Court ruling on acknowledgment.
Official case-page report only; the lower judgments and correspondence were not independently reviewed. Decision date: 2 November; discovery: 4 November. UK statutory reasoning is comparative.
