A wider route to expungement still requires a persuasive application
Justice Ministry guidance separates eligibility to apply from the Board’s decision to erase a criminal record.
Jamaica’s expanded expungement arrangements do not guarantee a clean record. In guidance published on 12 August, the Justice Ministry said people newly eligible under the amended Criminal Records (Rehabilitation of Offenders) Act must still satisfy the Board that relief is warranted.
The Senate had approved an expansion on 30 January, addressing restrictions that prevented consideration of some applicants sentenced to more than five years. The later ministry explanation described a broader assessment of rehabilitation, seriousness, remorse, restitution and the applicant’s subsequent conduct.
That distinction matters for people planning work, travel or professional applications: permission to submit an application is not a favourable decision. The ministry also described expanded treatment of foreign convictions; the report does not establish that a Jamaican decision erases records maintained overseas.
Official parliamentary and ministry reporting reviewed. The August report says amendments passed in February; the January source records the earlier Senate stage. The enacted text and commencement instrument were not independently obtained, so no individual eligibility calculation is offered.
