Unequal payments did not displace equal ownership of this home
The court upheld a joint-home division while treating a truck as separately owned.
Rosa Lawrence’s claim to a larger share of a jointly owned home failed in the Court of Appeal on 25 June. The court upheld the finding that she and Jermaine McLean each held a 50% beneficial interest despite unequal contributions to the purchase.
The dispute followed a long cohabiting relationship and also concerned rental income and a truck. The judgment applied trust principles to the jointly titled home, examining the parties’ whole course of dealings rather than simply adding their payments.
The trial judge had found pooled resources, joint mortgage responsibility and no later shared intention to change the equal ownership arrangement. The appellate court found no basis to disturb those findings. It also upheld the separate ownership finding concerning the truck, showing that a couple’s assets need not all follow the same ownership pattern.
Lawrence’s rental-income claim also failed on the accepted evidence that the rent met mortgage obligations after she stopped contributing. The appeal was dismissed with costs. That result reflects this financial history, not a general rule depriving absent co-owners of rental income.
This judgment applies trust principles to the parties’ domestic property arrangements. The rental-income and truck outcomes depend on the particular findings of fact; no universal entitlement or exclusion is stated. Later treatment not checked.
