Coastal land dispute puts environmental tribunal’s powers under scrutiny
A pending Trinidad and Tobago appeal asks how clearly environmental rules must be drafted and what remedies a specialist tribunal may order.
George Aboud and Sons and Las Cuevas Properties are challenging environmental enforcement over work on coastal land. The regulator alleged that clearing and grading on a steep gradient required environmental clearance which the companies had not obtained.
The Environmental Commission made a declaration and required an Administrative Civil Assessment of damages, rather than granting the injunction sought. After an unsuccessful domestic appeal, the companies brought an appeal as of right to the Privy Council, issued on 11 August 2026.
The questions concern the clarity of the designated activity and the Commission’s statutory powers to make declarations and require the assessment. The official page records an issued appeal, with no Privy Council judgment shown.
