Civil liability / Jamaica / Judgment report
Injury award limited by evidence of duration and financial loss
The court assessed the proved effects of a collision and rejected unsupported additional losses.
Jason Nicholas Facey received J$700,000 in general damages following a rear-end collision, but no special damages, in an assessment delivered on 13 April. The defendants’ absence did not relieve the claimant of proving the extent of the loss for which compensation was sought.
The court accepted the treating doctor’s evidence of injury, while finding insufficient support for the claimed continuing effects, additional treatment and interference with work and daily activities. There was no follow-up report establishing how long the symptoms lasted.
The judge compared earlier awards by the injuries and consequences actually proved, rather than treating a diagnostic label as a fixed tariff. Claims for earnings and household assistance also failed for lack of supporting evidence.
An expense paid by the claimant’s law firm was not awarded as his loss because no obligation to reimburse it had been proved. The final order added interest to general damages and assessed costs at J$70,000. The figure is a case-specific award, not a current compensation quote for similar injuries.
Assessment of damages only. This report avoids unnecessary personal and medical detail and does not independently update the historical comparators used by the judge. Complete official judgment reviewed; subsequent appeals or treatment have not been checked.
